FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH * * * THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 38775 of 2015 BETWEEN K.Saidaiah ... PETITIONER AND The State of Andhra Pradesh, rep. by its Principal Secretary and others ...RESPONDENTS Date of Order pronounced: 30.11.2015 ORDER:- Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
2. Petitioner states that his request of grant of No Objection Certificate (NOC) to the extent of Ac.4-89 cents in Survey No.158/7-B and Ac.1-59 cents in survey No.218/7 of Nadikudi Village, Dachepali Mandal, Guntur District, was examined by the fourth respondent and recommended for grant of NOC along with proposed errata to the second respondent as early as on 21.07.2015 under Ex.P14.
The Collector called for a detailed report vide proceedings in Rc.No.3232/2015-EE dated 30.06.2015 and in response to that the Tahsildar, fourth respondent, obtained a report from the Revenue Divisional Officer, third respondent and has sent a detailed report in Rc.No.204/2015-DT dated 23.04.2015. The primary grievance of the petitioner is that no decision has been taken so far by the second respondent and he seeks deletion of the said land from the list of prohibitory lands sent under Section 22-A of the Registration Act to the fifth respondent.
3. Since the proceedings as referred to above are still pending with the second respondent, I deem it appropriate to direct the second respondent to examine the said reports of respondent Nos.3 and 4 and take appropriate decision in the matter expeditiously preferably within six weeks from the date of receipt of a copy of the order.
