RESPONDENTS Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to declare the action of the respondents in not granting the periodical increment to the applicant from the date of payment of minimum pay time scales, implementation of PRC 2015 along with arrears as highly illegal, arbitrary, unjust, improper, discriminatory and contrary to various judicial pronouncements mentioned in the OA and consequently direct the respondents to release the periodical increments, HRA and the revision of pay scales to the applicant herein from the date of granting minimum pay scales with effect from 20.9.2011 vide Proceedings No.Bl/1385/2001 dated 29.09.
2006 issued by the 2nd respondent long with arrears as done in the case of similarly Situated persons through G.O.Rt.No.405 IU&H UD (D'1 ) Department dated 30.3.2012 and Memo. No. 13394/RD.SHGS.DRDA/Admnl2l12 dated 3.10.2013, which was issued in pursuance of orders of this Hon'ble Tribunal passed in O.A.No.7335/2010 dated 27.10.2O10 which was confirmed by the Hon'ble High Court in W.P.No.2433012011 dated 30.8.2011 which was confirmed by the Hon'ble Supreme Court in SLP No.2996312011 and passed in O.A.No.8638/2012 dated 2.7.2012 which was confirmed in W.P.No.6330/20'13 dated 22.3.2013 and also in accordance with the orders passed by the Hon'ble Tribunal on 30.1 .201 5 in O.A.No.440/20'l 5.
