THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.35717 OF 2015 ORDER:

The grievance of the petitioner is with regard to the rowdy sheet being maintained in his name on the file of Madanapalle II Town Police Station, Chittoor District.

The Sub-Divisional Police Officer, Madanapalle, filed a counteraffidavit conceding that the only crime that the petitioner was involved in, being Crime No.21 of 2010 registered under Sections 324 and 307 I.P.C. on the file of Madanapalle II Town Police Station, ended in his acquittal.

However, reference was made to the fact that on 06.03.2014, the petitioner along with others was found to have indulged in an altercation at a public place which led to his being bound over under Section 110(e) Cr.P.C. in Crime No.46 of 2014 by the Mandal Executive Magistrate, Madanapalle. The rowdy sheet opened in the name of the petitioner was stated to have been extended till 31.12.2015.

Learned Assistant Government Pleader for Home informed this Court that a review meeting would be conducted during December, 2015, to examine the necessity for extension of the rowdy sheet opened in the name of the petitioner.

In that view of the matter, as the police authorities concerned would have to apply their mind to the issue, it is unnecessary for this Court to adjudicate the present writ petition on merits. Needless to state, the police authorities concerned shall keep in mind the law laid down by this Court in Kamma Bapuji v. Station House Officer, Brahmasamudram[1] a n d Puttagunta Pasi v. Commissioner of Police, Vijayawada[2] and take appropriate action in the matter as per the relevant Standing Orders. The exercise in this regard shall be completed expeditiously and in any event, not later than the end of January, 2016. The decision taken during the review meeting shall be

communicated to the petitioner. It shall also be open to the petitioner to make a representation putting forth his case before the police authorities concerned and the same shall be taken into account during the review meeting.

The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
