THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T APPEAL NO.1173 OF 2018 JUDGMENT: (per SK,J) This appeal arises out of the order dated 30.08.2018 passed by a learned Judge of this Court disposing of I.A.No.1 of 2018 filed by the appellants in their writ petition, W.P.No.31009 of 2018. By the said order, the learned Judge observed that no cause was made out for stalling the exercise sought to be undertaken by the Northern Power Distribution Company of Telangana Limited but directed that the entire exercise, including promotions that may be effected pursuant to the impugned N.O.O.(CGM-HRD) Ms.No.158 dated 02.08.2018, shall abide by the result of the writ petition. Challenge in the writ petition was to the modified guidelines issued by the aforestated company vide N.O.O.(CGM-HRD) Ms.No.158 dated 02.08.2018. Pending disposal of the writ petition, the appellants-writ petitioners sought suspension of the operation of the said modified guidelines.

However, as stated supra, the learned Judge was not inclined to stall the exercise proposed to be undertaken by the company in terms of the modified guidelines but made the promotions subject to the result of the writ petition. By way of I.A.No.1 of 2018 filed in this writ appeal, the appellants-writ petitioners again seek suspension of the operation of the modified guidelines.

Sri Peeta Raman, learned counsel for the appellants, however, concedes that promotions have already been made in Jagitial District by the company as per the modified guidelines.

In that view of the matter, the question of suspending the operation of the said modified guidelines does not arise at this stage. As all the main issues are yet to be addressed by the appellants-writ petitioners in their pending writ petition, we see no cause to entertain this appeal. We may however reiterate that the learned Judge already observed that the entire exercise, including promotions, made pursuant to the modified guidelines would be subject to the result of the writ petition. The writ appeal is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed.
