HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.721 of 2015 ORDER:

This petition is filed to withdraw F.C.O.P.No.1293 of 2015 from the file of Additional Family Court, City Civil Court, Hyderabad, and transfer the same to Senior Civil Judge, Ramachandrapuram, East Godavari District.

Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 17.05.2014 as per Hindu rites and custom. She stated that during their wedlock they are blessed with a female child and that respondent looked after her well in the early days of their marriage, thereafter developed hostile attitude and started harassing her. She further stated that she suffered harassment in the hands of respondent and his parents and that she is now staying with her parents as she unable to meet the illegal demands of respondent. She stated that she received summons from Additional Family Court, Hyderabad, on the application filed under Section 9 of Hindu Marriage Act seeking restitution of conjugal rights.

She stated that she is a deserted wife and staying with her parents at Pallelapeta, Balabhadrapuram Village, East Godavari District, which is about 500 kms. away from Hyderabad. She stated that she is having months baby and it is difficult for her to travel from Balabhadrapuram to Hyderabad with baby and that she has no income of her own to meet the travelling expenses.

prayed for transfer of F.C.O.P.No.1293 of 2015 from Additional Family Court, Hyderabad to Senior Civil Judge, Ramachandrapuram. 3.

This Court permitted petitioner to take notice to respondent through registered post with acknowledgment due and in compliance of the said order, advocate for petitioner filed memo on 27.08.2016 stating that notice was sent to respondent on 12.08.2016 and as per the track report of the Postal Department, the article was delivered to respondent on 17.08.2016 and filed the track report copy along with memo. As per the track report, respondent received notice on 17.08.2016. In spite of service respondent neither appeared in person nor through any Advocate.

Heard advocate for petitioner.

Considering the reasons stated in the affidavit filed in support of petition and also considering the convenience of wife, F.C.O.P.No.1293 of 2015 is withdrawn from Additional Family Court, City Civil Court, Hyderabad, and transferred to Senior Civil Judge, Ramachandrapuram, East Godavari District, for disposal in accordance with law.

Transfer C.M.P. is ordered accordingly.
