HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.9016 of 2015 O R D E R :

The petitioner, who is accused in Crime No.204 of 2015 of Gopalpuram Police Station, Hyderabad, registered for the offences punishable under Sections 417, 420 I.P.C. and Section 7(1)(d) of Protection of Civil Rights Act, 1955, filed this petition under Section 439(1)(b) read with Section 482 Cr.P.C., seeking to relax the conditions imposed in Crl.M.P.No.997 of 2015, dated 15-07-2015 by the X Additional Chief Metropolitan Magistrate, Secunderabad i.e., "The petitioner shall deposit the passport before this Court, while presenting the sureties. The petitioner shall not leave Hyderabad without permission from the Court until further orders".

The trial Court while granting bail to the petitioner - accused, passed the order as follows :

"The petitioner/accused shall be enlarged on bail on executing the personal bond for Rs.10,000/- with one surety for the like sum. The petitioner shall deposit the passport before this Court, while presenting the sureties. The petitioner shall not leave Hyderabad without permission from the Court until further orders."

The learned counsel for the petitioner submits that the petitioner is associated with software companies, including the one in America and hence, he is finding it

difficult to attend his job/assignments outside Hyderabad city.

Considering the said facts and circumstances of the case, the conditions i.e., "The petitioner shall deposit the passport before this Court, while presenting the sureties. The petitioner shall not leave Hyderabad without permission from the Court until further orders" imposed by the trial Court are hereby set aside. The petitioner - accused is directed to execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh Only) with one surety for the like sum to the satisfaction of the trial Court for his appearance before the Court as and when required by the trial Court.
