THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.7395 of 2017 ORDER:

This Criminal Petition, under Section 482 of Cr.P.C., is filed by the petitioner/accused, seeking to quash the proceedings against him in F.I.R.No.263 of 2017 on the file of the Bhongir (R) Police Station, Rachakonda Commissionerate, registered for the offences under Sections 297 and 427 I.P.C., and Section 3(1)(t) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015.

Heard the learned counsel for the petitioner, learned Assistant Public Prosecutor representing the 2nd respondent-State and perused the record.

Learned counsel for the petitioner would submit that the subject land belongs to the petitioner-accused. On the other hand, it is being contended that it is a burial ground for the last six years. The petitioner had filed the copies of the revenue record showing that the land in dispute is belongs to the petitioner. 4.

In view of the circumstances, the interest of the petitioner is required to be protected. The truth or otherwise of the allegations can only be determined after investigation.

Under these circumstances, the Investigating Officer shall complete the investigation and file final report without arresting the petitioner.

With the above direction, the Criminal Petition is disposed of. Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
