aHON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI FAMILY COURT APPEAL No.125 of 2015 JUDGMENT: (ORAL) (Per Suresh Kumar Kait, J) The present appeal is filed against order dated 28.11.2014 passed in F.C.O.P.No.364 of 2011 by the Judge, Addl. Family court, Hyderabad, whereby the petition filed by the appellant herein, under Section 13(i)(iii) of the Hindu Marriage Act, for dissolution of marriage between the appellant and the respondent, has been dismissed. During the pendency of this appeal, appellant and respondent entered into settlement vide Memo dated 11.05.2018, whereby it is agreed that the appellant shall pay a sum of Rs.4 lakhs towards permanent alimony and full and final settlement on all counts of monetary relief/s such as maintenance, compensation and return of jewellery/gold ornaments as contemplated in MOU/Agreement dated 18.08.2010, which is part of the appeal.

The appellant has handed over to the respondent, bankers cheque of State Bank of India bearing No.165702 dated 16.04.2018 for a sum of Rs.4 lakhs.

The respondent is personally present in the Court and identified by her counsel Sri N.Laxman. The respondent states that the matter has been compromised with the appellant and she has no objection if this Court dissolves their marriage performed on 16.08.2009. In that view of the matter, we hereby dissolve the marriage between the appellant and the respondent performed on 16.08.2009. The Memo dated 11.05.2018 shall form part of the record.

SKK, J & AKS, J F.C.A.No.125 of 2015 The appeal is accordingly allowed. We hereby make it clear that the allegations levelled by the parties against each other through the proceedings pending before the trial Court are condoned by each of the parties.
