THE HON'BLE SRI JUSTICE DILIP B.BHOSALE CIVIL REVISION PETITION No.271 of 2015 ORDER:

Learned counsel for the petitioner does not press this civil revision petition and seeks direction to the Court below to decide I.A.No.2081 of 2014 within time frame.

I have perused the order, dated 18.11.2014, passed in I.A.No.2081 of 2014. It is ex parte order, whereby the petitioner is injuncted from encashing/invoking bank guarantee, dated 13.06.2014.

Learned counsel for the petitioner submits that the petitioner has already engaged an Advocate and he has entered appearance on its behalf before the Court below.

Keeping this in view and having considered the nature of order impugned in the present civil revision petition, I am inclined to accept the request made by the learned counsel for the petitioner.

Hence, the following order:

The civil revision petition is disposed of as withdrawn without examining the issue of maintainability. The Court below shall endeavour to dispose of I.A.No.2081 of 2014, as expeditiously as possible, and preferably within four weeks from the date of receipt of this order. The petitioner is allowed to produce copy of this order before the Court below within one week from today. It is made

clear that this Court has not examined the merits of the case. Consequently, miscellaneous petitions, if any, also stand disposed of. No costs.
