P. Chandra Mohan Reddy v. The Andhra Pradesh State Road Transport Corporation
HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.30795 OF 2017 O R D E R :
This writ petition is filed challenging the transfer order dated 04.09.2017 issued by the 3rd respondent, wherein the 3rd respondent transferred the petitioners to Kadapa depot, treating them as junior most drivers of Rayachoty depot and also excess. Learned counsel for the petitioners submits that in the middle of the academic year, petitioners cannot be transferred. He relied on the Notification dated 08.06.2017 issued by the 2nd respondent wherein the 2nd respondent directed all the Officers of Corporation to allow the employees who are working on deputation in four zones i.e. VZM, VJA, NLR & KDP, to continue at their respective current places of work without repatriating them till 30.06.2018. Sri A.
Rama Rao, learned Standing Counsel for respondent Corporation submits that the petitioners who were originally appointed in Chittoor Region are deputed to work in Rayachoti Depot, Kadapa Region; and that since they were found excess in Rayachoti depot they have been transferred to Kadapa Depot by impugned order, as such question of repatriation does not arise. He further submits that as the transfer of petitioners is on administrative ground, no interference is called for.
were found excess in the Rayachoti depot, more so, the distance between Rayachoti depot to Kadapa depot is not much. Normally, this Court will not interfere with the transfers, unless the same are punitive in nature. Further, as rightly contended by the learned Standing Counsel for the Corporation, the petitioners were not repatriated. They were transferred since they were found excess in the present depot. In view of the same, I do not see any reason to entertain the writ petition.
Accordingly, the writ petition is dismissed. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
