HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7460 of 2017 ORDER :

Heard learned counsel for the petitioners/ A1, A2 & A3 of Crime No.257 of 2017 on the file of the Panjagutta Police Station, Hyderabad, registered for the offences punishable under Sections 420 and 380 I.P.C. on the report of the 2nd respondent/ de facto complainant, no other than daughter-in-law of A1 and A2 and sisterin-law of A3 and also heard learned Public Prosecutor representing the State. Perused the grounds urged in the quash petition and other material on record.

Though it is the contention that the F.I.R. is a deleted F.I.R., it is premature from reading of the F.I.R. to quash the same as deleted, but for, the investigation is required to be done. Hence, there is nothing to interdict the investigation.

Having regard to the above, the Criminal Petition is disposed of, directing the police to proceed with the investigation and in the event of any necessity of arrest of the petitioners, they have to follow Section 41-A Cr.P.C. and the guidelines of the Apex Court as laid down in Arnesh Kumar v. State of Bihar1, strictly. Consequently, miscellaneous petitions, if any, pending shall stand closed.
