HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.6590 of 2017 ORDER:

The case of the petitioner is that he belongs to Scheduled Tribe and joined as Home Guard on 17-05-2007. Ever since his appointment as such, the petitioner has been discharging his duties to the satisfaction of all superiors and there are no complaints or adverse remarks against him during his service.

Presently, the petitioner has been attached to Sirgapoor Police Station, Sanga Reddy District. The 2nd respondent issued notification dated 31-12-2015 inviting applications for recruitment to the post of police constables and the petitioner submitted application and he was issued hall ticket and appeared for preliminary examination and later appeared for written examination also. The petitioner secured 71 marks, but his name does not found in the list of selected candidates. On enquiry, the petitioner came to know that candidates who secured less marks than the petitioner was selected and they are one Tukaram, Laxman and Ramedas, whose hall ticket Nos 332423, 370716 and 501017 and they secured 70, 68 and 65 marks respectively and they were selected. Aggrieved by the same, the present writ petition is filed.

Later respondents 2 and 3 are impleaded stating that they have also secured less marks than the petitioner and provided employment.

Counter affidavit is filed stating that the petitioner could not get selected for the post code 21 and 22 because of poor marks secured by him than the marks of the last selected candidate. The cut off marks for OC Home Guard for post-21 is 85 and for ST Home Guard is 83 in Medak District. For AR post, for OC Home Guard it is 85.50 and ST Home Guard there is no post notified. Further, for post code 24 the petitioner gave option for only two Battalions out of 12 battalions i.e. 1st battalion, TSSP, Hyderabad and 8th battalion TSSP, Kondapur, Ranga Reddy District. The cut-off marks for OC Home Guard for 1st battalion TSSP is 86.50 and ST Home guard is 84.75. For 8th battalion, TSSP cut off marks for OC HG is 83.75 and ST HG there is no post notified.

Since it is stated that the petitioner, who secured less marks for post 21, 22 and 24 for 1st battalion and 8th battalion, he could not get selected. The candidates mentioned by the petitioner are selected in 6th and 13th battalion, TSSP, Mancherial, Adilabad District respectively for which, the petitioner has not opted in the online application submitted by him.

Since the persons whom he compared opted for 6th and 13th battalion and the petitioner opted for 1st and 8th

battalion and cut-off marks for 1st and 8th battalion were more than the marks secured by the petitioner. As such, no relief can be granted and the writ petition is devoid of merits.

In view of the same, I do not see any reason to entertain the writ petition.

Accordingly, the writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 02-08-2017 Nvl
