THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.31067 OF 2015 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

The grievance of the petitioners is that the order of the Sub Collector, Madanapalle, Chittoor District, the 2nd respondent, in D.Dis(A2)/1590/2002, dated __.12.2013, is not being implemented by the Tahsildar, Punganur Mandal, Chittoor District, the 3rd respondent, as no de novo enquiry is initiated as per the directions. The petitioners appear to have filed two representations, dated 05.02.2014 and 15.04.2015, before the Mandal Revenue Officer seeking implementation of the order and ultimately filed the present Writ Petition alleging inaction.

It is evident from the order of the 2nd respondent that the directions were issued to the Mandal Revenue Officer to conduct de novo enquiry and the directions appear to have attained finality and must be implemented by the 3rd respondent. The petitioners are at liberty to bring the aforesaid non-compliance to the notice of the 2nd respondent and if the order is not complied with by the 3rd respondent, it is for the 2nd respondent to issue appropriate directions to ensure compliance of the order by issuing necessary further directions.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
