OFFICE NOTE 08.12.2025 SKS, J I.A.No.1 OF 2025 This application is filed praying this Court to direct the concerned SHO to forthwith accept the sureties produced by petitioner herein and complete the bail bond formalities in terms of bail order and without imposing any additional conditions of insisting on local sureties.
Heard both sides.
Learned counsel for petitioner submitted that petitioner is not native of Hyderabad, as such, in spite of best attempts, he is unable to furnish local surety, but the concerned SHO insists upon furnishing of local surety, causing grave prejudice to petitioner. Therefore, prayed this Court to allow this interlocutory application. On the other hand, the learned Additional Public Prosecutor, submitted that if there is no local surety, it is difficult to the investigating officer to trace whereabouts of petitioner, as he is
not a native of Hyderabad. Therefore, prayed this Court to dismiss this interlocutory application. Having regard to rival submissions made, and on going through the material placed on record, it is noted that petitioner is not a native of this place, due to which he is unable to furnish local sureties, in spite of best efforts. That being so, this Court directs the investigating officer to accept the sureties that are furnished by petitioner, and no insist upon furnishing local sureties as accused No.1 has already furnished one local surety.
Accordingly, this application is ordered.
