HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.1923 OF 2016 ORDER:

The present Criminal Petition under Sections 437 and 439 of Cr.P.C., is filed by the petitioner/A.2 seeking to enlarge him on bail in Crime No.307 of 2015 of Bahadurpura Police Station, Hyderabad, registered for the offences punishable under Sections 302, 120(B) r/w. 34 IPC and Section 25(1-B) of Arms Act, 1959.

A perusal of the material on record shows that on 08.02.2016, this Court rejected the request of the petitioner for release on bail in Crl.P.No.937 of 2016. Hence, there were no changed circumstances, either on facts or on law, warranting interference by this Court in the order passed by this Court on 08.02.2016, as held by the Hon'ble Supreme Court in KALYAN CHANDRASARKAR v. RAJESH RANJAN @ PAPPU[1]. Therefore, I see no grounds to consider the request of the petitioner for release on bail.

However, since the petitioner is studying Intermediate and examinations are likely to commence, the petitioner shall surrender and is at liberty to move appropriate application for bail after giving prior notice to the Public Prosecutor before the trial Court along with relevant material, in which event, the same shall be dealt

with in accordance with law.

Subject to the above direction, this Criminal Petition is dismissed.
