O R D E R

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, the Petitioner herein prays that this Hon'ble Court may be pleased to issue a Writ, Order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of 4th Respondent in not including the Petitioner's name in the list of Technical Bid for Apparaopalem Sand Reaches EA Nos.16832 and 16861 of Athmakur Mandal, SPS Nellore District as arbitrary, discriminatory and illegal and consequently direct the Respondents to include the Petitioner's name in the Technical Bid and Price Bid in respect of the said two Sand Reaches in pursuance to the Notification No.5689/DLSC/Sand/2015 dt.23.01.

2016 issued by the 3rd Respondent and consider the candidature of the Petitioner along with others for grant of quarry lease of the said Sand Reaches and with all other consequential benefits and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.' Learned Assistant Government Pleader for Mines and Geology states that in the light of the changed sand policy of the State, proposed auctions for grant of sand mining rights stand cancelled. In that view of the matter, this writ petition does not survive for consideration on merits and is accordingly dismissed. Interim order dated 18.02.2016 shall stand vacated. Pending miscellaneous petitions, if any, shall stand dismissed in the light of this final order. No order as to costs.
