THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2135 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/A-1 and A-2 in C.C.No.1295 of 2015 on the file of Additional Judicial Magistrate of First Class, Nuzvid, Krishna District, arising out of Crime No.85 of 2015 on the file of Veeravalli, Krishna District, registered for the offences punishable under Sections 448, 323 read with Section 34 IPC.

Heard the learned counsel for the petitioners and the learned Pubic Prosecutor.

After arguing for sometime, the learned counsel for the petitioners, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court. He further stated that the first petitioner/A-1 is working as Conductor in APSRTC and it is very much difficult for him to attend on each and every date of adjournment in view of his nature duty and the second petitioner/ A-2 is the wife of the first petitioner/A-1. He further stated that the identity of the petitioners is not questioned and is not disputing before the trial Court, as they are well known to the de facto complaint, and hence, the presence of the petitioners may be dispensed with.

In any event, considering the facts and circumstances of the case and in view of the submission made by the learned counsel for the petitioners, the presence of the petitioners before the trial Court is dispensed with except on the dates as and when their presence is required by the Court and the petitioners shall be

properly represented by their counsel.

With the above observation, this criminal petition is disposed of. As a sequel thereto, miscellaneous petitions, if any, pending in this criminal petition, shall stand closed. _______________ RAJA ELANGO, J Date: 22-02-2016 Ksn
