THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.31653 of 2018 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed seeking a Writ of Mandamus to declare the action of the 4th respondent in not considering the petitioner's representation, dated 18.08.2018, for grant of permission for construction of RCC roofed house in the place of existing asbestos sheet roofed house bearing No.2-153 in Sy.No.176/1 of Regulagudem Village, Kataram Mandal, Jayashankar Bhupalapally (Warangal) District, as arbitrary, illegal, unjustified and violative of the Articles of the Constitution of India and to consequently direct the 4th respondent to grant permission for the construction as desired by the petitioner, duly considering his representation afore-stated. I have heard the submissions of the learned counsel for the petitioner and of the learned Standing Counsel appearing for the 4th respondent.

Learned counsel for the petitioner, having drawn the attention of this Court to the afore-stated representation of the petitioner, submitted that there used to be a house with asbestos sheet roof and that, on account of heavy rains, the roof has been damaged and, therefore, the petitioner gave the representation to the 4th respondent to accord permission to reconstruct the house with RCC roof and that the same is not considered and disposed of.

Learned Standing Counsel submits that the representation of the petitioner will be considered and disposed of within four weeks.

In the result, the Writ Petition is disposed of directing the 4th respondent to consider and dispose of, in strict accordance with the procedure established by law, the representation, dated 18.08.2018, of the petitioner within four weeks from the date of receipt of a copy of this order and intimate the decision taken thereon to the petitioner within a week thereafter. No order as to costs.

As a sequel, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
