THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 20106 of 2016 ORDER :

This Writ Petition came to be filed with the following prayer: "issue a direction or order more particularly Writ of Mandamus while declaring the illegal interference of the 5th respondent without any Court orders or direction to supporting the encroachment of the 6th respondent when the matter is sub-judice before the competent Court the interference of the official respondent is highly arbitrary, unconstitutional, illegal, improper and consequently direct respondents 2 to 5 not to interfere in the civil disputes and not to call the petitioner to the police station by pouring threats to evict the petitioner in illegal manner from her residence as illegal, arbitrary and violating the natural justice."

Heard learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Telangana appearing for respondents 1 to 5. Since this Court is not adjudicating the case on merits, it may not be necessary to hear respondent No.6. The case of the petitioner is that at the instance of respondent No.6, respondent No.5 is interfering with the civil disputes between the petitioner and respondent No.6 in respect of the property which is subject matter of the suit for partition bearing O.S.No.188 of 2000 on the file of the IX Additional Chief Judge, City Civil Court, Hyderabad. Learned Assistant Government Pleader, on instructions, states that respondent-police are not interfering in civil disputes and they are acting in accordance with law.

Recording the said submission, the Writ Petition is disposed of making it clear that any action taken by the police shall be in accordance with law.

Miscellaneous petitions pending, if any, in the Writ Petition shall
