HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 43542 of 2016 ORDER:
1) Heard learned counsel for the petitioners, Government Pleader for Revenue and Government Pleader for Endowments. With the consent of all the parties, the writ petition is being taken up for hearing at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the impugned letter dated 02.12.2016 issued by respondent No.3 as illegal, arbitrary and violative of principles of natural justice; and consequently direct respondent Nos.2 and 3 to register the Power of Attorney dated 08.11.2016 in respect of land admeasuring Ac.0.60 cents in Sy.No.199/ A of Macherla Village and Mandal, Guntur District. 3) Though various grounds are raised, learned counsel for the petitioners restricts his prayer seeking a direction to the third respondent to pass reasoned order on merits as the impugned order is bereft of any reasons. Government Pleader for Revenue did not dispute the same.
4) Having regard to the above, the impugned order dated 02.12.2016 is set aside and consequently the third respondent is directed to pass a reasoned order basing on the material placed before him, in accordance with law, as early as possible, preferably, within a period of four (04) weeks, from the date of receipt of a copy of the order.
5) With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
