HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36069 of 2016 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the writ petition being heard at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.2 in not disposing of the appeal in Rc.No.(C3)/ 602/ 2015 filed by the petitioner under Section 5 (5) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971, for cancellation of pattadar pass books issued in favour of respondent Nos.3 and 4, as arbitrary, illegal and contrary to law.

3) Though various grounds are raised in the writ petition, the grievance of the petitioner is that though the appeal was filed in the year 2015 till date no orders passed in the appeal. 4) The Government Pleader for Revenue submits that a direction may be issued for an early disposal of the appeal. 5) Without going into the merits of the case and having regard to the arguments advanced, the present writ petition is disposed of, directing respondent No.2 to dispose of the appeal in Rc.No.(C3)/ 602/ 2015 filed by the petitioner under Section 5 (5) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971, for cancellation of pattadar pass books issued in favour of respondent Nos.3 and 4, after hearing all the concerned including

the petitioner, in accordance with law, as expeditiously as possible, preferably, within a period of three (03) months from the date of receipt of a copy of the order. There shall be no order as to costs.

6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
