M/S. Celebrity Housing Infra Projects Pvt. Ltd. v. The State Of Telangana

THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.31676 OF 2018 ORDER :

Heard learned counsel for the petitioner and the learned Government Pleader for Transport.

It is brought to the notice of this Court that, in similar situation, in W.P.No.5286 of 2018, this Court allowed the said Writ Petition, by way of an order, dated 02.05.2018. A copy of the said order, operative portion of which reads as under, is placed on record.

"Accordingly, the Writ Petition is allowed and respondents are directed to refund a sum of Rs.51,000/- collected from the petitioner towards life tax in excess of the life tax payable by the petitioner under the Sixth Schedule to the Act on the invoice sale price, to the petitioner within four

(04) weeks from today. No costs".

Following the above said order, and for the reasons recorded therein, this Writ Petition is also allowed, directing the respondents to refund a sum of Rs.1,20,600/- (rupees one lakh twenty thousand and six hundred only), collected from the petitioner herein towards life tax in excess of the life tax payable by the petitioner under the Sixth Schedule to the Act on the invoice sale price, to the petitioner within four (04) weeks from today. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
