HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.522 of 2015 ORDER:

This petition is filed to withdraw O.P.No.472 of 2015 from the file of Family Court, Ranga Reddy District at L.B. Nagar and transfer the same to Family Court, Srikakulam for disposal in accordance with law.

2. O.P.No.472 of 2015 is emanated out of a family dispute between husband and wife. Wife filed this petition. According to her affidavit, her marriage was performed with respondent on 26.07.2012 at Gummadi Ramakrishna Reddy Function Hall, Bollaram, Secunderabad as per Hindu rites and caste customs and that they are blessed with a male child, who is now aged about 2 years. She further stated that respondent and his family members harassed her physically and mentally and having unable to bear the torture, she left the marital home and living with her parents. She further stated that respondent with a malafide intention in order to further harass her and create inconvenience to her filed O.P.No.

472 of 2015 before Family Court, Ranga Reddy with false allegations and it is difficult for her to travel from Srikakulam to Ranga Reddy covering a distance of about 900 KMs for the purpose of defending O.P.No.472 of 2015 filed by respondent herein. She further stated that as per the judgments of Apex Court, convenience of wife has to be looked into in matrimonial cases. She further stated that she filed DVC No.1 of 2015 and the same is pending before Judicial First Class Magistrate, Kothuru, Srikakulam District and sought for transfer of O.P.No.

Court, Srikakulam.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

4. Heard advocate for petitioner.

5. Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P.No.472 of 2015 is withdrawn from the file of Family Court, Ranga Reddy District at L.B. Nagar and transferred to Family Court, Srikakulam for disposal in accordance with law.

6. Accordingly, the Transfer Civil Miscellaneous Petition is ordered. No costs. Miscellaneous Petitions, if any pending, in this petition, shall stand closed.
