THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO I .A.No.1 OF 2018 in WRI T APPEAL No.1182 OF 2018 and WRI T APPEAL No.1182 OF 2018 COMMON ORDER: (per Hon'ble Sri Justice Sanjay Kumar) Though this appeal by the State of Telangana and its authorities has been presented with a delay of 157 days and I.A.No.1 of 2018 has been filed therein seeking condonation of the said delay, we are not inclined to entertain the matter as perusal of the order sought to be challenged reflects that it is in the nature of a consent order. That apart, Ms.P.Lakshmi Priya, learned counsel representing Mr.P.V.Ramana, learned counsel for the respondent-writ petitioner, would inform this Court that the ground for filing this appeal appears to be a Memo which was never brought to the notice of the learned single Judge.
On both grounds, we are of the opinion that this is a fit case for the State and its authorities to go before the learned Judge and seek review of the order, if sufficient grounds are made out therefor, and not a case for invocation of appellate jurisdiction. I.A.No.1 of 2018 and W.A.No.1182 of 2018 are accordingly dismissed reserving liberty to the appellants to do so in accordance with law.
Other pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
