HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.12143 OF 2017 ORDER:

This writ petition is filed seeking a direction to declare that the respondents 4 and 5, have no locus standi to take legal action against the petitioner in view of the bar under the A.P. Charitable and Hindu Religious Institutions Endowments Act, 1926 (for short, the "Act"). Heard the learned counsel for the petitioner and the learned Government Pleaders for respondents.

In view of the specific bar under Section 41 of the Act, the specific relief of the nature which the petitioner claiming cannot be granted in the writ petition. However, considering the plea of the learned counsel for the petitioner that the petitioner had made a complaint/representation dated 26.08.2014, the same shall be considered by the 2nd respondentCommissioner, in accordance with law. Accordingly, the writ petition is disposed of directing the 2nd respondentCommissioner, to consider the complaint/representation dated 26.08.2014 of the petitioner and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of copy of this order. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand disposed of as infructuous.
