HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.46609 of 2016 ORDER:

This writ petition is filed seeking to declare the registration of FIR No.274 of 2016, dated 18.11.2016, of Jammikunta Police Station, Karimnagar District, under Section 420 IPC and Section 4 of the Dowry Prohibition Act, basing on the complaint given by the 4th respondent, as illegal and arbitrary, and consequently to quash the same.

Heard and perused the material available on record. The case of the petitioners is that the 4th respondent lodged the present complaint against the petitioners before the 3rd respondent, who registered the same as FIR No.274 of 2016 against the petitioners for the offences under Section 420 IPC and Section 4 of the Dowry Prohibition Act. It is alleged in the said complaint that the 1st petitioner came to the house of the 4th respondent and settled his match with the sister of the 4th respondent by name Bogam Rajitha and took an amount of Rs.10,000/- as advance for dowry amount of Rs.4,00,000/- in the presence of his parents and later, the 1st petitioner is postponing the matter and when the 4th respondent asked the 1st petitioner about the same, the 1st petitioner bluntly refused to marry his sister for want of additional dowry and thus, the petitioners cheated the 4th respondent and his sister by demanding additional dowry amount.

The main grievance of the petitioners is that the 3rd respondent, with the instigation of the 4th respondent, is trying to arrest the petitioners.

Learned counsel for the petitioners submitted that the petitioners are ready to co-operate with the investigation. Considering the said facts and circumstances and the submission of the learned counsel for the petitioners, the 3rd respondent is directed to complete the investigation in FIR No.274 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. The petitioners are directed to execute personal bond for a sum of Rs.5,000/- (Rupees five thousand only) each with one surety for the like sum each to the satisfaction of the Investigation Officer concerned as surety for their future appearance for the purpose of investigation.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ RAJA ELANGO, J Date: 2nd January, 2017 KL
