Madupu Sudhakar v. The State Of Telangana,
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.39648 OF 2015
O R D E R
The grievance of the petitioner was that the police authorities were harassing him by calling him to the police station frequently without any complaint or case having been registered against him.
The Inspector of Police, Uppal Police Station, Cyberabad Commissionerate, filed a counter-affidavit stating that Crime No.843 of 2015 was registered under Sections 420 and 498A IPC read with Sections 3 and 4 of the Dowry Prohibition Act, 1961 on the file of Uppal Police Station upon the complaint made by the petitioner's daughter-in-law. Due to oversight, the name of the petitioner was not mentioned in the said FIR but subsequently, he was named as Accused No.3 therein before submission of the same to the competent Court. In the light of the aforestated development, the petitioner's allegation that he is being subjected to harassment without involvement in any criminal case no longer holds good.
The writ petition is accordingly closed. This order shall however not preclude the petitioner from taking recourse to appropriate remedies in accordance with law if he is aggrieved by his implication in the aforestated crime. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs. ______________________ SANJAY KUMAR, J 23rd DECEMBER, 2015 Svv
