THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.38552 OF 2014 ORDER:

This Writ Petition is filed seeking the following relief: "... to issue an Order, direction, writ more in the nature of Writ of Mandamus declaring the action of respondents 1 to 3 in not initiating action against respondents 5 to 7 in high handedly, illegally demolishing part of house property bearing No.4-1-454 corresponding to old No.4-1-312 situated near Tower Circle, Karimnagar, as bad, illegal, arbitrary, opposed to principles of natural justice in violation of Article 14, 19, 21, 300-A of Constitution of India consequently directing the respondents 1 to 4 to initiate action against respondents 5 to 7 as per law for causing damage to the petitioner in a sum of Rs.40,000/- and he pleased to pass such other order or orders." 2.

Learned Assistant Government Pleader for Home has produced before this Court the written instructions, dated 31.01.2020, issued by the Assistant Sub-Inspector of Police, Karimnagar I Town Police Station, Karimnagar District, and stated that pursuant to the complaint filed by one Kamarapu Shashi Kumar, alleging that the accused therein (petitioner herein was arrayed as accused No.1) created false documents and executed a registered gift settlement deed in respect of the subject property, a case in Crime No.367 of 2014 of Karimnagar I Town Police Station was registered for the offences punishable under Sections 420, 465, 467, 468, 471, 120-B, 504 and 506 I.P.C. and in the said crime, investigation was completed, charge sheet was filed and the case is pending trial vide C.C.No.196 of 2015 on the file of Judicial Magistrate of First Class, Karimnagar.

In the light of the above, since the matter is pending before the criminal Court, leaving it open to the criminal Court to deal with the matter, the Writ Petition is closed.
