HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 31735 of 2018 ORDER:
1) Heard learned counsel for the petitioners and Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage itself.
2) The present writ petition came to be filed questioning the action of the respondents in not considering the application made by the petitioners under Form 6A for mutation and issuance of pattadar pass books. 3) By an order dated 08.03.2018, this Court in W.P.No.7594 of 2018, while disposing of the said writ petition, permitted the petitioners to file an appropriate application in Form VI A of the Telangana Rights in Land and Pattadar Pass Books Act (for short, 'the Act'). Subsequent thereto, the petitioners are said to have made the application dated 29.03.2018.
4) It is stated that though the application was made in the month of March, 2018, till date, the same is not considered. 5) On the other hand, learned Government Pleader would submit that the material on record would not show filing of such application before appropriate authorities. He submits that request of the petitioner cannot be considered since the
request for mutation is sought to be made basing on an agreement of sale.
6) Having regard to the above, the Writ Petition is disposed of directing the Tahsildar to consider the representation of the petitioner under Form VI A of the Act, if made and not disposed of, in accordance with law, after hearing all the concerned, as early as possible, preferably within a period of three months from the date of receipt of a copy of the order.
