HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9415 OF 2018 ORDER:
Heard learned counsel for the petitioners and learned Public Prosecutor representing the State.
The petitioners are suspected to have been involved in a non-bailable offence for the offences punishable under Sections 498-A IPC and Sections 3 & 4 of Dowry Prohibition Act. As with those allegations the defacto complainant sent a copy of alleged complaint through WhatsApp to the petitioners and if they arrested at her instance the police may deal with third degree methods.
Learned Public Prosecutor opposed the bail application saying counselling in progress and no crime was registered but for GD entry if any.
Having regard to the above, this Criminal Petition is disposed of with a direction to police in the event of registration of crime to strictly follow Section 41-A Cr.P.C. and the guidelines of the Apex Court in Arnesh Kumar v. State of Bihar1 and also to refer the couple for counselling for any possibility of reconciliation.
