HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.1351 of 2012 ORDER:

This writ petition is filed by the petitioners seeking a direction to the respondents to maintain open piece of land admeasuring 735 sq. yards adjacent to the houses bearing Nos.10-3-734/1, 2 & 3 corresponding to LIGH 279/3RT, 280/3RT and 281/3RT situated at Vijayanagar Colony, Hyderabad, for recreation purpose as per the directions of this Court vide order dated 21.7.1987 in W.P.No.10447 of 1985, by removing the constructions existing thereon.

When this matter has come up for hearing, it is submitted on behalf of the 4th respondent that power is vested with the 5th respondent to take a decision with regard to the land in question. It is submitted on behalf of the 5th respondent that A.P. Housing Board is the owner of the said piece of land and if the said land is vested with the 5th respondent, as per the Rules and Regulations, the 5th respondent will maintain the same for recreation purpose.

Recording the above submission, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
