HON'BLE SRI JUSTICE P NAVEEN RAO CRIMINAL PETITION NO. 20 OF 2015 ORDER:

This criminal petition is filed under Section 438 of Cr.P.C by petitioner /accused in FIR No.217 of 2014 of Manakondur Police Station, Karimnagar district for the offences punishable under Sections 3(1)(x) of the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act, 1989.

2. Heard the learned counsel for petitioner and learned Additional Public Prosecutor for respondent -State and perused the material placed on record.

3. The allegation against the petitioner/accused is that on 19.12.2014 at about 4.30 pm he along with others abused the defacto complainant in filthy language touching the caste.

4. Learned counsel for petitioner submitted that petitioner is falsely implicated into the crime and the allegations alleged against him in the complaint do not constitute any offence and in abuse of process of law.

Having regard to the above, the Criminal Petition is disposed of by giving liberty to petitioner/accused to surrender before the learned Special judge concerned and to move regular bail application after notice to the public prosecutor and in such an event the learned Special Judge concerned is required to consider on its own merits the application to grant bail preferably on the same day, if not atleast on next day and subject to such conditions as may be necessary. __________________
