THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.31538 OF 2017 ORDER:

Assailing the order of the Arbitrator (Registrar and Deputy Registrar of Chits), a dispute was traised by the Chit Fund Company alleging default in payment of chit amount. 2.

Against the said order, appeal lies under Section 70 of the Chit Funds Act, 1982 (for short, 'the Act'). Without availing the said remedy of appeal, the petitioner filed this Writ Petition. 3.

Since the petitioner has an effective and efficacious remedy of appeal, this Court is not inclined to entertain the Writ Petition and keep the same pending.

The Writ Petition is accordingly dismissed leaving it open to the petitioner to avail the remedy of appeal under the Act. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in the Writ Petition shall stand closed.
