HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.32405 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the respondents in trying to interfere with the possession and enjoyment of the patta land of the petitioners admeasuring Ac.1.02 1⁄2 gts situated at Sy. No.404/5 of Lingareddypally Village, Siddipet Mandal and District, as illegal and arbitrary.
The grievance of the petitioners appears to be that the local leaders and the real estate people are influencing the revenue authority to take the possession of the subject land of the petitioners and to allot the same to the third parties.
The learned Government Pleader for Revenue, disputes the interference and trying to take out the possession of the subject land of the petitioners forcefully by the revenue authority. He further submits that if any action is being taken by the revenue authority for taking the possession of the petitioners, the same would be done by following due process of law.
Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 3rd respondent-Tahsildar, to follow due process of law, before taking any steps to dispossess the petitioners from the subject lands, if the petitioners are in possession of the same or allot the subject land to others.
With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
