HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.21022 of 2017 ORDER:

This writ petition is filed by the petitioner challenging the proceedings dated 6.5.2017 issued by the 4th respondent. 2.

The case of the petitioner is as follows:

The petitioner-society is a Roman Catholic Organization. It owns and possesses the lands in Madinaguda village, Serilingampally Mandal, Ranga Reddy District. There is a compound wall on all sides of the land of the petitioner. The petitioner is running a recognized minority school in the said land. While so, the GHMC authorities initiated proceedings against the school and the 4th respondent issued a notice on 11.11.2016, for which, a representation was made on behalf of the school. On 7.3.2017, another notice was issued by the 4th respondent, for which, a reply/representation was given by the school management. On 6.5.2017 the 4th respondent issued the proceedings impugned herein stating that a compound wall was constructed by encroaching the road unauthorizedly and therefore, appropriate action will be taken. Aggrieved by the same, the petitioner filed this writ petition.

When this matter has come up for hearing, Sri Sampath Prabhakar Reddy, learned Standing Counsel appearing for GHMC fairly submitted that the impugned proceedings were issued without taking into consideration the reply/representation given by the school management. 4.

Recording the above submission, the Writ Petition is disposed of setting aside the proceedings impugned herein and directing the respondents concerned to issue fresh orders after considering the

reply/representation made by the management of the petitioner's school. No costs. Pending miscellaneous petitions, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 28.6.2017 Nn
