HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 188 of 2013 ORDER:
The petitioner was appointed as Mike Operator in the second respondent-Temple by proceedings of the Chairman of the Trust Board in the year 1990. Thereafter, as the Trust Board was abolished, the post of Mike Operator was also abolished. The petitioner filed a suit in O.S.No.3 of 1991 and obtained orders to continue him as a 'Mike Operator and 2nd Archaka' pending disposal of the suit. On 01.04.1994, the petitioner was appointed as Attender in the second respondent-Temple. Thereafter, he made a representation to the first respondent on 02.02.2006 seeking to appoint him as Second Archaka and the said representation was considered by the Trust Board and
issued proceedings on 21.02.2007 appointing him as Second Archaka in the subject temple with effect from 01.02.2007. He further submits that the Executive Officer of the second respondent-Temple issued proceedings dated 15.11.2008 promoting him as Archaka in the second respondent-Temple and it was also stated in the said proceedings that he (the petitioner) is entitled to draw pay and allowance as per 2005 Pay Revision Commission.
Thereafter, the Deputy Commissioner, Endowments Department, Kakinada by proceedings dated 6.5.2009 permitted the Executive Officer of the second respondent-temple to extend the benefit of 22% Interim Relief on the existing 2005 PRC. Thereafter 2010 PRC came into effect and when the same was not implemented, the petitioner submitted a representation on 6.4.2013. When the said representation was not considered and disposed of till today, he filed WPMP.No.24826 of 2016 in the main Writ Petition which was originally filed seeking a direction to the second respondent to implement proceedings dated 15.11.2008 by continuing him as Archaka in the subject temple.
When the matter is taken up for consideration, the learned Counsel for the petitioner as well as learned Standing Counsel for the respondents agree for disposal of the main Writ Petition with a direction to the respondents to consider the representation of the petitioner dated 6.4.2013 and accordingly a direction should go to the respondents to consider the representation of the petitioner dated 6.4.2013 and pass appropriate orders thereon in accordance with law within a period of two months from the date of receipt of a copy of this order.
Subject to the above, the Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
