HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31731 OF 2018 ORDER :

This writ petition is filed challenging the action of 1st and 4th respondents in not taking any action on the complaint filed by the petitioner against 5th and 6th respondents and for a consequential direction to the respondents to register a case against the 5th respondent.

Learned Assistant Government Pleader for Home produced written instructions stating that petitioner made complaint on 19.07.2018 making allegations only against the 6th respondent; and that basing on the said complaint a case in Crime No.91/2018 was registered against the 6th respondent. It is also stated that the contention of the petitioner that she has given complaint against both 5th and 6th respondents, is incorrect; and that the petitioner has made allegations in her complaint only against the 6th respondent and no specific allegations are made against the 5th respondent.

But, the learned counsel for the petitioner referred page No.20 of the material papers, which is a complaint against the 5th respondent. But, there is no date or acknowledgment for the same.

Learned counsel for the petitioner states that complaint has been made to higher authorities for non registration of crime against 5th respondent.

But the fact remains when the petitioner made complaint to 4th respondent, she made allegations only against 6th respondent and basing on the said allegations Crime No.91/2018 was registered against the 6th respondent. It is also stated that the Assistant Superintendent of Police, Paderu, Visakhapatnam Distruct, has conducted investigation in the said crime, wherein no evidence was adduced requiring to add 5th respondent as accused in the said crime. It is also stated that the investigation is in progress.

Recording the aforesaid written instructions of the learned Assistant Government Pleader, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 11.09.2018 t k.
