HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT PETITION No. 2294 of 2016 ORDER:
The action of respondent Nos.3 and 4, in interfering with petitioner's civil rights, at the behest of respondent No.5, is questioned in the Writ Petition as being illegal and arbitrary.
The grievance of the petitioner is that, on 19.01.2016, when he went to his land along with one Sri Narasimha Rao and his brother's son, the police attached to respondent No.4 Police Station had taken him to police station and made to sit till evening, abused in filthy language and threatened to bequeath the land in question in favour of respondent No.5, in default, crime under Section 420 IPC would be registered against him.
Learned Assistant Government Pleader for Home (AP) submits that police have registered FIR No.94 of 2015 and completed investigation; on 27.02.2016, the Sub-Inspector of Police, Parchur Police Station served notice under Section 41(a) Cr.P.C. to A.1 to A.4 and filed charge sheet before the Judicial Magistrate of First Class, Parchur on 02.03.2016; and C.C. number is awaited.
In view of the fact that police had since completed investigation and filed charge sheet before the Judicial Magistrate of First Class, Parchur, respondent - police
officials are directed not to interfere with the civil rights of the petitioner.
With the above observation, the Writ Petition stands disposed of.
Miscellaneous petitions, if any pending, shall stand closed.
