O R D E R

The case of the petitioner is that prior to the commencement of A.P. Scheduled Area Land Transfer Regulations, 1 of 1959, she purchased the subject property and has been in possession and enjoyment of the same. But the 3rd respondent - Special Deputy Collector (Tribal Welfare), Badrachalam, Bhadradri - Kothagudem District, based on the complaint of unofficial respondent No.5, invoking the provisions under the above said Regulations, which in fact have no application, passed orders in LTR Case No.92/2017/PNK dated 03.05.2018, for eviction, without affording the petitioner any opportunity. Aggrieved by the order dated 3.5.2018, she filed appeal to the 2nd respondent - Additional Agent to Government on 23.08.2018, along with a petition seeking to suspend the proceedings of the 3rd respondent dated 3.5.2018 pending the appeal. As no orders have been passed on interim suspension petition, present writ petition has been filed.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Social Welfare.

Having regard to the above facts and circumstances of the case and the submissions of the leaned counsel, writ petition is disposed of directing the 2nd respondent to dispose of the appeal in accordance with law. Till the disposal of the appeal, status quo obtaining as on today with regard to possession over the subject property shall be maintained.
