The petitioner is a Fair Price Shop dealer of Shop No.26, Penchikalpet Village, Bejjur Mandal, Adilabad District. While so, the shop of petitioner was inspected on 15.07.2015 and found some variations in the quantity of sugar 6A proceedings were initiated and they are pending. A show cause notice was issued to the petitioner by the second respondent, but no proceedings were taken up by the third respondent. When the essential commodities were not supplied to the petitioner, the present writ petition is filed though for a different relief challenging the order passed by the second respondent dated 23.07.2015.

Learned counsel for the petitioner submits that though 6A proceedings are pending against the petitioner, since no action was taken against his authorisation, he is entitled for supply of commodities. The learned Government Pleader could not get any instructions with regard to suspension or cancellation of authorisation of the petitioner.

In the above said circumstances, this Writ Petition is disposed of directing the respondents 3 and 4 to supply essential commodities to the petitioner so long as the petitioner's authorisation is in force and valid. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
