HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.684 of 2014 ORDER:
This petition is filed to withdraw O.P.No.77 of 2014 from the file of Senior Civil Judge, Peddapalli, Karimnagar District and transfer the same to Principal Senior Civil Judge, Kothagudem, Khammam District for disposal in accordance with law.
2. Petitioner herein is wife and she filed her affidavit in support of petition, according to which, her marriage was performed with respondent on 22.11.2002 and they are blessed with a male child on 29.10.2003 and now he is school going child. She further stated that respondent herein earlier filed O.P.No.4 of 2004 before Senior Civil Judge, Kothagudem for divorce with false and baseless allegations and that petition was dismissed for default on 29.03.2007. She further stated that respondent again filed O.P.No.77 of 2014 before Senior Civil Judge, Peddapalli for the same relief of divorce on the same allegation that was made in the earlier O.P.No.4 of 2004 intentionally showing her address at Alluru village, Ramagundam Mandal, Karimnagar District, though he has knowledge that she is residing at Kothagudem.
She further stated that she is residing at her parents' house in Kothagudem along with her minor child and it is very difficult for her to travel from Kothagudem to Peddapalli, which is nearly 200 KMs away from her place of residence for the purpose of defending O.P.No.77 of 2014. For these reasons, she prayed for transfer of O.P.No.77 of 2014 from Senior Civil Judge, Peddapalli, Karimnagar District to Principal Senior Civil Judge, Kothagudem, Khammam District.
3. Respondent in spite of service of notice neither appeared in person nor through any advocate.
4. Heard argument of advocate for petitioner.
5. Advocate for petitioner submitted that petitioner/wife got job at Palvancha as Junior Plant Attendant and now she is residing at Kothagudem, Khammam District along with her minor child and old parents and it is difficult for her to attend
Peddapalli Court from Kothagudem, which is nearly at a distance of 200 KMs.
6. I have perused the material papers including affidavit filed in support of transfer petition. Considering the reasons stated in the affidavit and also considering the convenience of petitioner/wife, O.P.No.77 of 2014 is withdrawn from Senior Civil Judge, Peddapalli, Karimnagar District and transferred to Principal Senior Civil Judge, Kothagudem, Khammam District for disposal in accordance with law.
7. Accordingly, the Transfer Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
