THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4651 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/accused seeking grant of anticipatory bail in connection with crime No.528 of 2014 on the file of the Police Station, Saroornagar, Cyberabad, registered for the offence under Section 306 IPC.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

The allegation against the petitioner is that the deceased was called by the petitioner over phone and threatened her to leave one Ashok as she intends to marry him. Even according to the dying declaration and the complaint, the said conversation was done over phone. Aggrieved over the same, the deceased committed suicide.

In view of the facts and circumstances of the case, and also in view of the fact that the petitioner is a lady and that the deceased having a fragile mind committed suicide, this Court is inclined to grant anticipatory bail to the petitioner. In the circumstances, the petitioner/accused is directed to surrender before the Magistrate concerned within a period of fifteen days from today and on such surrender, she shall be enlarged on bail on her executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for a like sum each to the satisfaction of the said Magistrate. Further, the petitioner/accused is directed to report before the Station House Officer as and when required.
