THE HON'BLE SRI JUSTICE S.V.BHATT Writ Petition No.11838 of 2013 ORDER:
Heard learned counsel for the petitioner and Sri R.Radha Krishna Reddy, learned Standing Counsel for the 3rd respondent. Petitioner prays for Mandamus declaring the action of respondents in acquiring the property of petitioner bearing House No.12-1-886/A, Asifnagar, Hyderabad, in an extent of 475 square yards without recourse to law or payment of compensation as illegal and unconstitutional.
This Court through order, dated 18.04.2013, protected the possession and enjoyment of petitioner as follows: "Learned Government Pleader for Revenue seeks time to get instructions.
Post on 22.04.2013.
Till then, there shall be no demolition of petitioner's house bearing No.H.No.12-1-886/4 (correct house No.12-1886/A), Asifnagar, Hyderabad." Sri R.Radha Krishna Reddy, learned Standing Counsel, on instructions, submits that the property of Smt.Fareeda Begum, covered by H.No.12-1-886/4 (correct House No.12-1-886/A), Asifnagar, Hyderabad, is not subjected to acquisition proceedings. As and when the respondents either require this property or intend to acquire, they will follow the procedure stipulated by law, acquire and then dispossess the petitioner. The stand of the learned Standing Counsel is placed on record.
The writ petition is disposed of accordingly. No order as to costs.
Miscellaneous petitions, if any, filed in this writ petition shall also stand disposed of.
