HON'BLE SRI JUSTICE CHALLA KODANDA RAM CIVIL REVISION PETITION No.4012 of 2012 ORDER:

When the matter has taken up for hearing, learned counsel for the petitioners submitted that the petitioners have already filed the medical certificate before the Court below in the suit in O.S.No.82 of 2011 on the file of Senior Civil Judge, Kavali. In those circumstances, I do not find any reasons to interfere with the order dated 28.06.2017 passed by the Senior Civil Judge, Kavali dismissing the I.A No.416 of 2017 in O.S.No.82 of 2011 filed seeking for appointment of Advocate Commissioner for recording the evidence at Visakhapatnam as there was no material before the Court below with respect to the claim made by the petitioners. However, the learned counsel for the petitioners asserts that he had infact filed the medical certificate in which case it is open for the petitioners to go and file the review petition before the Court below.

With the above observations, the civil revision petition is disposed of. Miscellaneous Petitions pending, if any, in this civil revision petition shall stand dismissed. No order as to costs. ______________________________ CHALLA KODANDA RAM,J Date:18.08.2017.
