THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14905 of 2024 ORDER:

Seeking the Court to enlarge the petitioner who is arrayed as accused in S.C.No.235 of 2023 on the file of the Fast Track, Special Judge for Trial and Disposal of Rape and POCSO Act Cases, Ranga Reddy District at L.B. Nagar, on bail, the present Criminal Petition is filed. 2.

Heard Sri K. Mohan Goud, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner submitted that the respondent police falsely implicated the petitioner in the case. Although a non-bailable warrant was issued against the petitioner on 30.11.2024, for non-appearance, it is submitted that the petitioner was actually in jail, having been falsely implicated in another case in Crime No.615 of 2024. Having since been granted bail in that case, the petitioner remains in judicial custody due to the pendency of the present case.

With the investigation completed and the matter posted for trial, the petitioner is willing to furnish sufficient sureties and prays for release on bail.

Considering the submissions made by both the learned counsel and a perusal of the material available on record, this Court notes that the trial Court issued a warrant on 30.01.2024. The counsel for the petitioner contends that the petitioner had been regularly attending Court, but was subsequently falsely implicated in another case, resulting in his non-appearance before the trial Court. The trial Court had dismissed the bail petition of the petitioner. However, with the case now listed for examination under Section 313 of the Cr.P.C., the counsel for the petitioner assures that the petitioner will henceforth attend Court regularly. In view of these circumstances, this Court deems it fit to grant bail to the petitioner subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) each, with two sureties for a like sum each to the satisfaction of the Fast Track Special Judge for Trial and Disposal of

Rape and POCSO Act Cases, Ranga Reddy District at L.B. Nagar.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
