HON'BLE SRI JUSTICE R.SUBHASH REDDY CIVIL REVISION PETITION No.3907 of 2015 ORDER :
This Civil Revision Petition, under Section 22 of the A.P. Buildings (Lease, Rent and Eviction) Act, 1960, is filed by the petitioner/respondent aggrieved by the judgment dated 17.07.2015 in R.A.No.71 of 2009 passed by the Additional Chief Judge, City Small Causes Court, Hyderabad, dismissing the appeal and confirming the order dated 21.08.2008 in R.C.No.149 of 2005 passed by the IV Additional Rent Controller, Hyderabad.
2. Heard learned counsel for the petitioner/respondent as well as the learned counsel for respondent/petitioner and perused the material on record.
3. In view of the concurrent finding of fact recorded by both the Courts below, I do not find any merit in this civil revision petition.
4. However, in view of the request made by the learned counsel for petitioner/respondent for grant of some time to secure alternate accommodation, the petitioner/respondent is granted six months time from today to vacate the subject premises, subject to the petitioner/respondent filing an undertaking before the Registry of this Court to the effect that he would vacate the subject premises before expiry of six months from today and also pay the rents regularly, including arrears of rent, if any.
5 . Subject to the above direction, this civil revision petition is dismissed, at the stage of admission. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
