THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.31719 of 2018 ORDER:

When the matter is taken up, written instructions, dated 04.09.2018, furnished by the S.I. of Police, Payakaraopeta P.S., Visakhapatnam District, are placed on record by the learned Government Pleader for Home.

As per the said instructions, after seizure of the vehicle, Crime No.123 of 2018 under Section 379 IPC., and Section 21(1) of the Mines and Minerals (Development and Regulation) Act, 1957, was registered on the file of Payarakaraopeta P.S., and the police also produced the property before the learned Additional Judicial First Class Magistrate, Yellamanchili.

In view of the same, leaving it open for the petitioner herein to move an appropriate application before the learned Magistrate, the Writ Petition is closed. There shall be no order as to costs.
