THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.18318 of 2015 ORDER:
The petitioner was appointed as a fair price shop dealer of shop No.10 of Umamaheswarapuram Village, Mundlamuru Mandal in Prakasam District. A show cause notice was issued on 17.09.2014 asking the petitioner to submit his explanation on two allegations. The petitioner submitted his explanation and after considering the same, an order was passed on 21.10.2014 keeping the authorization of the petitioner under suspension. When the said order was challenged in W.P.No.32875 of 2014, this Court disposed of the said Writ Petition on
05.11.2014 suspending the order dated 21.10.2014. Thereafter, the fourth respondent passed an order on 27.02.2015 canceling the authorization of the petitioner. Against the said order, the petitioner preferred an appeal to the third respondent, and when no orders were passed by the third respondent, the petitioner filed W.P.No.6291 of 2015, and this Court, by order dated 12.03.2015, directed the third respondent herein to dispose of the appeal as well as the stay petition filed by the petitioner.
The third respondent ultimately passed an order on 07.06.2015 confirming the order passed by the fourth respondent on 27.02.2015. Against the said order, the petitioner filed a revision before the second respondent on 15.06.2015 and simultaneously filed the present Writ Petition.
This Court, by order dated 23.06.2015, granted interim suspension of the impugned order, pending further orders. Now, the third respondent as well as the impleaded sixth respondent appeared before this Court by filing counter affidavits and submitted that interim arrangements were made on 13.06.2015 itself consequent to the orders passed by the third respondent. In the circumstances, this Court is not inclined to interfere with the said arrangement. But, however, the second respondent is directed to dispose of the revision filed by the petitioner on 15.06.2015, within a period of two months from the date of receipt of a copy of this order by giving due opportunity to the petitioner.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
