THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.1696 OF 2009 ORDER:
This writ petition is filed challenging the action of the respondents 1 and 2 in conducting the second interview on 30.09.2008 without issuing any fresh notification as illegal and arbitrary.
As per the affidavit of the petitioner, interview was conducted for four candidates, but the selected candidate expired and in the list, the next candidate got selection as staff nurse. In those circumstances, the petitioner should have been given appointment since she got more marks than the fourth respondent, but the fourth respondent was given appointment. Her allegation is that the marks were manipulated and the fourth respondent was stated to have got 25 marks in stead of 19 1⁄2 marks, whereas the petitioner secured 20 marks. In those circumstances, she filed the present writ petition. It is also her case that the fourth respondent did not study S.S.C., in Z.P.High School, Kanigiri, and she produced fake and forged documents. There was no interim order in the writ petition. The appointment orders might have been issued.
No counter affidavit is filed by the respondents. In view of the continuance of the fourth respondent, this writ petition is disposed of giving liberty to the petitioner to submit a representation to the authorities if there is any allegation of submission of forged documents by the fourth respondent, and as and when such representation is filed by the petitioner, the authorities shall consider the same and pass appropriate orders after due enquiry.
The writ petition is accordingly disposed of.
