HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.949 of 2016 O R D E R :

The petitioner, who is accused in Crime No.106 of 2015 of Chejerla Police Station, SPSR Nellore District, registered for the offence punishable under Section 3(1) (x) of S.Cs. & S.Ts. (PoA) Act and Sections 506 and 509 I.P.C., filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.

The allegations against petitioner are not so serious in nature, but, in any event, as there is a bar for grant of anticipatory bail to the accused in the crime registered for the offence under Section 3 (1) (x) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, the petitioner is directed to surrender before the Court where the F.I.R. is pending and file bail application and on such surrender and filing of bail application, the Court where the F.I.R. is pending is directed to release petitioner - accused on bail, on the same day, on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with one surety for a like sum and further petitioner - accused is directed to appear before the Respondent-Police as and when required.
